I-130 Immigrant Visa
- If you are a US citizen you can file this petition for your spouse, parents, children and siblings.
- If you are a green card holder you can file this petition for your spouse and your unmarried children only.
I-485 Adjustment of Status
- You can file this petition if the beneficiary is in the US.
- Adjustment of Status is the process through which an immigrant in the U.S. adjusts his or her status to that of a permanent resident. In order to qualify for adjustment of status, the applicant must file an application for adjustment of status with the USCIS. Additionally, the applicant may be able to apply for employment authorization and advance parole to travel while the application is pending.
- How long does it take to obtain my green card?
- That depends on which USCIS service center is working on your case which could take in general about one year.
- Can I work in the U.S. while my application is being processed?
- Yes, but only after you receive your Employment Authorization which in turn might take about three months to receive.
- Can I travel abroad while my application is pending?
- Yes, but only after you receive the approval of the advanced parole. Which in turn might take about three months to receive. Otherwise, your application would be considered abandoned hence, it would be cancelled.
